In accordance with the Federal Law for the Protection of Personal Information held by Private Parties (Private Data Protection Law), the applicable rules and regulations thereto, it is hereby notified that The Yacht Experiences brand and www.theyachtexperiences.com, which belong to the company Toto Rentals SA de CV, whose domicile is in Puerto Aventuras, Solidaridad, QR, Mexico, and whose telephone number is +(52) 984 195 0104, is responsible for processing personal, non-sensitive data voluntarily provided by clients and potential clients and belonging to natural persons and legal entities, including full name, age, sex, address, current employment, telephone numbers and work and/or personal e-mail, signature, photograph, and credit card and debit card number, or another other method of payment. THE COMPANY collects the aforementioned personal, non-sensitive data directly from the data holder or from individuals who work for the data holder (in the case of legal entities), through registration forms, websites, e-mail, fax, or by telephone. THE COMPANY does not collect the aforementioned information by means of cookies or web beacons. Personal information collected by THE COMPANY, and which is by no means sensitive data pursuant to the applicable regulations, is principally used and processed to contact clients or potential clients in order to sell products and services, and to close sales transactions therewith. THE COMPANY does not sell personal information which has been provided and does not share the aforementioned information with third parties outside the employees or companies belonging to the same group, for the purposes set forth in this notice. If you do not expressly object to the processing of said data, it will be deemed that your consent has been granted. In addition, THE COMPANY will be able to use your personal information for the following purposes, which are not necessary for the purposes described in the previous paragraph, but which facilitate and allow THE COMPANY to offer a better service, such as by sending mailings with invitations and publicity related to its products and services. You have the right to limit the use and diffusion of personal data for publicity purposes, therefore if you do wish to receive publicity regarding our products and services, please request the corresponding form from an executive or feel free to contact our Privacy Department by sending an e-mail to [email protected] and requesting to be added to the “exclusion list”, with the possibility of being granted documentary proof thereof, if required. Likewise, you also have the right to prevent THE COMPANY from contacting you for publicity purposes by registering with the Federal Consumer Protection Agency’s (PROFECO) Public Registry of Consumers. In any case, objections to personal data being used for secondary purposes shall not constitute a reason to be denied services and products which, if applicable, you request or contract from THE COMPANY. You have the right to know what personal information we have collected from you, what it is used for, and the terms of use of such data. Likewise, you have the right to request that your personal information be corrected if it is outdated, inaccurate or incomplete; that it be deleted from our records or databases if you consider that it is not being used in accordance with the principals, duties and obligations set forth in the regulations; and to object to your personal data being used for specific purposes. These rights are known as the ARCO rights. Each request must include the full name of the applicant, contact details and the right being exercised. Once the request has been received through the aforementioned means, our Privacy Department staff will contact you in a lapse no greater than 3 business days, to inform you of the procedure and requirements to exercise your ARCO rights, including the means by which the data holder’s identity and/or identity of third party representation of the data holder will be accredited, in order to deal with any query which may arise with regard to the processing of your data. You may revoke consent, where applicable, which has been granted to THE COMPANY with regards to processing your personal data, by following the same procedure set out in the previous paragraph. Nevertheless, it is important to bear in mind that it is not always possible to attend your request or withdraw the use of data immediately in every case, given that we may be required to continue processing your data due to a certain legal obligation. Likewise, it must be considered that for certain purposes, revoking your consent will mean that we are no longer able to continue rendering the service you have requested from us, or that it shall result in a termination of your relationship with us. THE COMPANY shall adopt the necessary safety measures to safeguard personal, non-sensitive data provided to us. Any complaint related to confidential information processed by THE COMPANY may be made directly to the Federal Institute for Access to Information and Protection of Data (www.ifai.org.mx). By sending your data and/or filling out forms and fields on our website, you thereby grant consent for your personal information to be processed in accordance with the provisions of this privacy notice.
